Member Stories - Vehicle fails to give way on right turn

British Cycling member Joanne Ness has successfully recovered damages in relation to a road traffic accident, which occurred on 8 September 2011, as she was cycling along Alcester Road, Wythall, Birmingham.

As Joanne was travelling on her bicycle a third party vehicle, travelling in the opposite direction, failed to give way to her and made a right hand turn cutting across her path. As a result of the impact, Joanne was thrown from her bicycle and sustained personal injury, damage to her bicycle and other consequential losses.

Liability for the accident was admitted by the defendant. Joanne received compensation for her personal injury and the damage to her bicycle.

Joanne was represented by Tamsin Keogh in Leigh Day and Co.’s Cycling and Sports Injuries Team and her claim was supported and funded by British Cycling.
