British Cycling member Dominic Whyte has successfully recovered damages in relation to a road traffic accident, which occurred on 28 August 2010, as he was cycling along A46.

As Dominic was travelling on his bicycle along A46 between Cheltenham and Stroud, the Defendant who was travelling in the opposite direction, turned right into Buckholt Road, crossing Dominic’s path when it was unsafe to do so and Dominic had right of way. Dominic was unable to avoid the Defendant’s vehicle and collided with the passenger side of the Defendant’s vehicle.

As a result of the impact Dominic was thrown from his bicycle and sustained personal injury, damage to his bicycle and other consequential losses.

Liability for the accident was admitted by the defendant. Dominic received compensation for his personal injury and the damage to his bicycle.

Dominic was represented by Faqir Nawaz in Leigh Day and Co.’s Cycling and Sports Injuries Team and his claim was supported and funded by British Cycling.
