Cyclist concludes compensation claim for injuries
British Cycling member Paul Brown has successfully concluded his claim for compensation against a motorist, who caused him to sustain a number of painful injuries as a result of a road traffic accident, which occurred whilst Mr Brown was out on a training ride with his wife on 18 September 2004.
Consequentially, the injuries Mr Brown suffered as a result of this accident caused him months of significant pain and discomfort, which in turn ruined months of training. Substantial damage was also sustained to Mr Brown’s Casati bicycle and clothing for which compensation was also recovered.
The Defendant’s insurers sought to deny liability on behalf of their insured despite criminal prosecution proceedings being raised against the motorist. Quantum was agreed (subject to liability) between the parties and Brit Insurance finally delivered compensation in the absence of an admission of liability to Mr Brown, which also took into account a substantial claim for care and assistance provided by Mr Brown’s wife following the accident and Mr Brown’s loss of amenity.
