Traced Vehicle Registration Leads To Successful Claim
British Cycling member, Scott Belshaw, has successfully concluded his claim for personal injury compensation arising from a road traffic accident, which occurred on 26 April 2006. Scott is a serious and competitive cyclist who was involved in a road traffic incident as he was out on a training ride with two other club cyclists.
The incident occurred as the group were cycling in single file along High Street, Bury at approximately 19.17 hours. A third party motorist attempted to overtake the group and failed to notice the presence of an oncoming vehicle. Whilst in the process of overtaking the group the motorist suddenly realised there was insufficient room to pass and swerved left towards the kerb forcing his way in between the second and third rider almost running Scott off at speed and then slamming his brakes on, leaving Scott nowhere to go. A collision consequently occurred and Scott was thrown over the handlebars of his bicycle, on to the back of the third party vehicle and then on to the road. The motorist then proceeded to drive off at speed.
Thankfully Scott and his fellow cyclists managed to record the registration number of the vehicle involved, which they reported to the Police. The Police were successfully able to trace the vehicle involved, which then led to third party insurers being identified. Had the vehicle not been traced, Scott would have had to direct his claim to the MIB under the Untraced Drivers' Agreement and he would have not recovered compensation for his damaged bicycle, cycling clothing or shoes.
Scott sustained a number of painful soft tissue injuries as a result of this frightening incident. We are pleased however, to confirm that Scott made a full recovery which enabled him to resume competitive cycling.
